W&P Newsletter – New Stricter Supervision Rules by the Government for Imports of Used Capital Goods

Indonesian Minister of Trade just issued a new regulation on importation of used capital goods (Minister of Trade Regulation No. 17 of 2018 – “Regulation 17 of 2018”), which amends a number of provisions set forth under the previous Ministry of Trade Regulation No. 127/M-DAG/PER/12/2015 of 2015 and Ministry of Trade Regulation No. 90 of 2017. Regulation 17 of 2018 came into force as of 1 February 2018.

These regulations open the possibility to import used capital goods, but in doing so, they set certain strict requirements upon the importers, including to obtain a prior approval from the Minister of Trade and to import only used capital goods specifically listed in the regulations of 2015 and 2017 (subject to the HS codes).

Regulation 17 of 2018 introduces additional stricter conditions by requiring: (i) post-border import documents inspection or assessment and (ii) importers to prepare written statements of compliance. For those imported not in accordance with the regulations, Regulation 17 of 2018 mandates the Importers to withdraw and destroy the goods.
